These Terms & Conditions of Use and Sale (hereinafter the “Terms”) govern access to the site decatv.com and the contractual relationship between DecaTV (hereinafter “we”, “the seller”) and any individual or entity who orders a service (hereinafter “you”, “the customer”).
The Terms set out how orders, payment and delivery of access work, as well as the rights and obligations of the parties. Any order implies unreserved acceptance of these Terms, unless a mandatory provision states otherwise.
The essential features of the offers (duration, device compatibility as shown on the site, activation terms) are presented on the product and catalog pages. Prices are shown in euros including tax where VAT applies, or excluding tax where relevant, with a clear indication on the order page.
The contract is formed when we confirm that your order has been accepted (email, message or acknowledgement on the channel used). We reserve the right to refuse an order in the event of a prior dispute, suspected fraud or service unavailability.
The price payable is the one displayed at the time of confirmation, subject to any obvious typographical error. Payment is due via the methods offered (bank card, transfer, PayPal, etc.). In the event of non-payment or a bad-faith chargeback, we may suspend delivery or cancel the order.
The access or credentials needed for the service are provided via the channels indicated at the time of order (email, messaging). Stated activation times are indicative; a reasonable delay related to payment verification or maintenance does not constitute a major breach of contract, provided you are informed.
We make reasonable efforts to ensure the availability of the service. Interruptions (maintenance, updates, force majeure, failure of a third-party provider) may occur without this automatically giving rise to compensation, within the limits provided by law.
The elements of the site (text, design, logos, structure) are protected. Any unauthorised reproduction is prohibited. Trademarks mentioned are cited for information about compatibility or the market; they remain the property of their respective owners.
Within the limits permitted by applicable law, our liability shall not exceed the amount paid by the customer for the order concerned over the last twelve (12) months. We are not liable for indirect damages (loss of opportunity, loss of data, commercial harm) except in the case of proven gross negligence or a contrary mandatory legal provision.
We do not control content broadcast by third parties on the internet; any complaint about content must be made to the rights holders or the platforms concerned.
Where the right of withdrawal applies (in particular for consumers in the European Union), its terms and any exceptions relating to the supply of digital content are set out in our returns and refunds policy, which forms an integral part of the contractual documentation.
The processing of your data is described in our privacy policy, which is GDPR-compliant.
Neither party shall be held liable for a failure due to an unforeseeable, irresistible and external event within the meaning of applicable law (natural disaster, war, widespread network outage, etc.).
We may amend these Terms. The applicable version is the one online on the date of your order, unless a unilateral change is imposed by law or accepted by you for an ongoing order under the terms indicated.
Subject to any mandatory provisions more favourable to the consumer, these Terms are governed by French law. In the event of a dispute, and failing an amicable resolution within a reasonable time, the competent courts shall be those of the applicable jurisdiction, in accordance with the jurisdiction rules of the European Union and national law.
In accordance with Article L. 612-1 of the French Consumer Code, the consumer may use, free of charge, a consumer mediator whose contact details appear on the site economie.gouv.fr after first making a written approach to the seller.
